Mutchler Sentenced to Four Years for Manslaughter

The first murder trial in Scotland County in more than 30 years wrapped up on December 1st in Shelby County where Judge Gary Wallace sentenced Michael J. Mutchler to two four-year terms in the Missouri Department of Corrections, to run consecutively.

Mutchler was found guilty of involuntary manslaughter and armed criminal action in the 2008 shooting death of Joseph Alvey in rural Scotland County.

Involuntary manslaughter in the second degree is a class D felony and is subject to a prison term of up to five years. Armed criminal action is an unclassified felony, punishable by imprisonment by the department of corrections for a term of not less than three years. The punishment is in addition to the manslaughter sentence. No person convicted under this subsection shall be eligible for parole, probation, conditional release or suspended imposition or execution of sentence for a period of three calendar years.

The jury trial in Shelby County concluded on October 16th. The sentence was handed down December 1st.

Mutchler was given credit for time served, 539 days, while awaiting trial and sentencing.
